Terms of Service
These terms are an agreement between you and CastrosBot (“we”) about the CastrosBot Discord bot, dashboard and website (the “Service”). By adding the bot to a server, using its commands or logging in to the dashboard you agree to them. If you add the bot on behalf of a community or organisation, you agree for it too.
1. Who can use the Service
You must meet Discord's minimum age in your country and follow Discord's Terms of Service and Community Guidelines. You sign in with your Discord account; keep it secure.
2. The Service
The Service provides leaderboards, a virtual economy and games, verification, role automation and related tools. Features and limits depend on the server's plan (see Pricing). We may add, change or remove features, and new servers may need our approval.
3. Virtual currency and games
Coins, items, badges and winnings are virtual, have no monetary value, and cannot be bought with, sold for or exchanged for real money or anything of value, through us or anyone else. The casino games are for entertainment only; no real-money gambling is offered. Balances may be reset or adjusted to fix errors or abuse. Server moderators can refund in-server store purchases in coins; that is not a real-money refund.
4. Server admins
Server owners and admins control which features run in their server and who moderates it, and are responsible for their configuration, their moderators' actions, and informing their members about the bot (including our Privacy Policy).
5. Acceptable Use Policy
You must not:
- Use the Service to break the law or Discord's Terms, Community Guidelines or Developer Policy;
- Abuse the bot or its API, including spamming commands, scripting or automating interactions, evading rate limits or cooldowns, or deliberately overloading the Service;
- Exploit bugs to gain coins, items or access (report them to us instead), or attempt to access other servers' or users' data;
- Probe, scan or test the Service's security without our written permission, or interfere with its operation;
- Reverse engineer the Service except where the law allows, or copy it to build a competing service;
- Trade virtual currency or items for real money or anything of value;
- Upload or submit illegal, infringing, sexual content involving minors, hateful or harassing content, or malware;
- Impersonate us, Discord or anyone else, or use the Service to phish for credentials.
We may limit, suspend or remove access, block players from games, or remove the bot from a server that breaks these rules.
6. Paid plans
Paid plans are subscriptions billed per server, monthly or yearly, through Stripe. They renew automatically until cancelled. You can cancel at any time from the dashboard (“Manage subscription”); the plan stays active until the end of the period you've paid for. If a payment fails the server may drop to the free plan. We may change prices with at least 30 days' notice before your next renewal. Prices may exclude taxes, which are added where required.
7. Refund Policy
Subscriptions are digital services that start immediately, so payments are non-refundable, including for partly used periods, except:
- where the law requires a refund (nothing in these terms limits your statutory consumer rights); or
- where we decide, at our discretion, to approve a refund, for example after a billing error or a long outage. Ask at support@castrosbot.theinkwell.dev within 14 days of the charge.
Approved refunds go back to the original payment method through Stripe.
8. Your content
You keep ownership of what you submit (for example leaderboard entries and server messages). You give us the permission we need to store, process and display it to run the Service. You're responsible for having the rights to it.
9. Availability and changes
We aim for high availability but the Service is provided without an uptime guarantee and may be interrupted for maintenance, by Discord outages or for reasons beyond our control. Escrowed game stakes are protected against restarts as described on our Security page.
10. Ending your use
You can remove the bot from your server at any time. We may suspend or end the Service for anyone who breaks these terms, or stop offering it with reasonable notice; if we stop the Service for everyone we'll refund the unused part of any prepaid period.
11. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose and non-infringement. The Service is not affiliated with or endorsed by Discord.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose (or US$50 if greater). Some jurisdictions don't allow these limits, so they may not apply to you.
13. Indemnity
If you use the Service in breach of these terms or the law, you agree to cover reasonable losses and costs we incur as a result, to the extent the law allows.
14. Governing law
These terms are governed by the laws of USA, without regard to conflict-of-law rules. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in.
15. Changes to these terms
We may update these terms. We'll change the date above and, for material changes, give notice in the dashboard at least 14 days before they apply. Continuing to use the Service after that means you accept them.
